DEEE Necessity
Decree No. 2020-1725 amends the relevant provisions on the extension of producer's responsibility. The regulations stipulate that the minimum annual collection target of producers and ecological organizations should reach 65% of the average weight of electrical and electronic equipment launched by the country in the first three years, or 85% of waste electrical and electronic equipment. The current DEEE regulation comes from EU Directive 2012/19/EU, transformed into French Act from Decree No. 2014-928, supplemented by five ministerial decrees and notices issued to producers. When producers put electrical and electronic equipment (EEE) on French market, they must provide customers with equipment take back and recycling solutions.
Identifier
each type of electrical and electronic equipment placed on the market after August 13, 2005 must be marked to identify its producer and determine its placement on the market after this date. If placed after August 13, 2005, producer must meanwhile affix the left pictogram on each type of household electrical and electronic equipment sold on the market. If the size of the equipment does not allow, the pictogram is to appear on the package and in the attached warranty document and user manual. These provisions enter into force on January 1, 2021.

What is the Packaging Act?
Since 1992, environmental regulations have included the Extended Producer Responsibility (EPR) of household packaging. It involves any company that puts household or consumer packaging products on French market and involves its waste management responsibility.
In order to protect the environment, to reduce waste pollution and to promote the recycling rate of packaging materials, the Directive covers all packaging entering the EU market and its packaging waste, whether in industry, trade, administration, services, or in household and other fields, and no matter what materials they are made of. Sellers are required to register and claim licenses, otherwise the products will not be warehoused or sold.
Necessity
What packaging will be affected? - Household packaging: products sold or provided free of charge to families; products put on the market for household consumption or for the use of its contained products.
What companies will be affected? - 1. Producer of products put on the French market: responsible for packing; regardless of weather the brand is printed on the package or not; they are packaged under a private label. 2. Introducers and importers of packaging products purchased abroad (in and out of the EU) and resold in the French market. 3. Person responsible for putting packaged products on the market for the first time: issuer (producer of service packaging produced or sold to families for filling at the sales site. such as the so-called small commodity packaging; checkout / shopping bags; packaging used for transporting products for home delivery); introducer / importer (packaging products used for imported from the EU member state or for imported to French market.)
The amendment of this decree not only defines the producer, but also defines that cross-border seller is a producer and bear the obligations and responsibilities of producer. The decree specifies the implementation date of the regulations. It may be delayed due to the epidemic, but will be implemented soon. The implementation will be very strong, because the regulations specify the recycling tasks and objectives in the next few years, and government authorities and environmental protection organizations are bound to implement this goal. Ignoring the regulations may bring fines, shop close, and seriously may involve criminal crimes. If being supervised, it is very likely to trace the seller's sales records in the previous three years and seller has to pay the recycling fee altogether. Do not try to evade payment by concealing or omitting reports. French regulators can ask the platform to provide sales data at any time.

What is the Battery Act?
The EU has introduced Battery Directive 2006/66/EC, which has entered into force in EU member states since September 26, 2008, replacing the first Battery Directive 91/157/EC that has not achieved its goal. Battery Directive 2006/66/EC was amended in Battery Directive 2013/ 56/EU of November 20, 2013. The first clause of Article 16 of Decree No.2020-1725 of December 29, 2020 also amended the battery part in the original Environmental Code and made it clear that the implementation date is January 1, 2021 . The Seller shall be responsible for the sold batteries and recycle the waste batteries.
Necessity
In order to ensure that the annual individual recycling rate in France shall not be less than 45%, the regulations require producers of portable batteries and accumulators to take measures. It sets collection targets applicable to producers or their ecological organizations to achieve at least this proportion. Each EU country needs to implement the battery Act through legislation, promulgation of administrative measures and other means as appropriate. Therefore, sellers need to register separately.
If your company is listed as a battery producer or seller in EU member states, your sales in France will be subject to the following obligations: ◆ register recycling member in France; ◆ provide funds for recycling and disposal of batteries at the end of life; ◆ ensure that new batteries put on the market after September 26, 2008 comply with the Directive substance restrictions for mercury and cadmium; ◆ new batteries put on the market after September 26, 2008 are marked with crossed pulley trash cans. If the content of mercury, cadmium and lead in the battery exceeds a certain concentration, it shall be marked with chemical symbols; If it is a portable or automotive battery, shall mark the battery capacity on; ◆ ensure that the waste battery and accumulator can be easily taken out when designing electrical appliances; If the end user cannot easily remove it, must ensure that the electrical equipments are designed in such a way that the waste batteries and accummulators can be easily removed by qualified professionals independent of the producer; ◆ the definition of 'battery producer' is the first person to bring the battery to the market in EU member states, including the built-in battery in household appliances.
